Terms of service
Clear expectations for creative tools, fictional content, generated results and your own work.
Prelaunch draft · Updated November 2, 2026. Production services and legal review are pending. This is not yet a finalized legal notice.
1. Service, operator and status
Midsummer Fruit provides naming tools, original fictional editorial stories and local creative workspaces intended for novelists, comic creators and other storytellers. These terms describe the current development edition intended for midsummerfruit.com. Updated November 2, 2026.
Midsummer Fruit is operated by Jousten, based in China. Contact email: livesjon01@gmail.com. Postal address: Room 2705, Building A, Shidai Building, Louxing District, Loudi, Hunan, China.
The intended age audience remains pending. Governing-law and dispute provisions require review before public launch. The postal address does not establish a binding choice of law or court.
2. Using the tools
No registration or payment is required in this edition. You may generate, compare, copy and locally save names, create private scenes and export your own work. The interface identifies implemented tools, unfinished stories and editorial review status. Research candidates are planning records, not a promise that every proposed tool will be built.
You are responsible for the material you enter and for deciding whether a result fits your work, audience and setting. Do not use the service for unlawful activity, harassment, impersonation, deceptive attribution, privacy violations, unauthorized collection of personal data or infringement of others’ rights. Ordinary fictional aliases are supported; real-world misuse is not endorsed.
3. Generated names and creative explanations
Names may coincide with existing people, businesses, works, trademarks, domain names or accounts. We do not promise uniqueness, exclusive rights, registrability, commercial clearance or freedom from third-party claims. You should conduct checks appropriate to your intended use. Suggestions for domains and handles do not represent availability results.
Invented morphology, role notes, estimated sound patterns and narrative interpretations are creative aids. They are not verified name meanings, etymologies, cultural facts or legal advice. A source-backed tool states its dataset, period, coverage and limits. Similarity warnings are prompts to review a cast, not a scientific determination that readers will or will not confuse characters.
4. Your material and generated output
You retain whatever rights you have in the character notes, manuscripts and other original material you provide. The local app does not claim ownership of that material and does not publish it. The service does not grant you rights in any third-party material you enter.
You may copy, adapt and export the generated rule-based name combinations and private scene output for your creative work. To the extent the operator can grant permission in its contributions, it permits that use, including commercial creative use. That permission is not a warranty of copyright protection, exclusivity, legal clearance or ownership of a short name. Rights in AI-generated material can vary with law and the contributions involved.
5. Public stories, data and attribution
The public stories are original fiction created for this project with AI assistance, not real user experiences or testimonials. Human editorial review status is stated honestly. Events and relationships in a fictional story are not historical evidence. No assertion of literary originality is established by a word counter or automated test.
The repository’s original creative dataset is designated CC0-1.0. External datasets retain their own recorded terms and factual limitations. Public editorial stories and interface design are not automatically covered by the dataset designation; the repository license file states their status. You may use the tool results as described above, but do not republish the full editorial articles as your own or copy the site wholesale without applicable permission.
6. Local storage, backups and loss
Favorites, history, projects and saved character scenes are stored in the current browser profile. There is no account recovery, cloud backup or cross-device synchronization. Clearing site data, changing devices, using private browsing, storage eviction or software problems may remove local work.
Export backups regularly. Import replaces local data only after validation and confirmation, but you remain responsible for choosing the correct file. Delete controls remove local records, not independently downloaded files or clipboard copies. The service is a creative aid, not the sole recommended storage location for a manuscript.
7. Privacy and unpublished work
The Privacy policy explains actual storage and request behavior. Current naming generation and private story fragments run locally; no external AI call is made by the user interface. Do not include sensitive personal information that you do not need for your creative task.
If a future optional AI service is enabled, its provider, transferred fields and relevant retention and use terms must be disclosed before use. An API key must remain server-side. The service must not automatically convert private story material into public pages, analytics payloads or model-training data.
8. Technical restrictions and fair use
Do not attempt to bypass access controls, extract secrets, overload endpoints, evade rate or cost limits, inject executable content or interfere with other users. You may report defects responsibly through the real contact route when available.
Generation limits, bounded input lengths, deduplication and retry boundaries protect reliability. When constraints exhaust a small dataset, partial results are possible. A disabled external feature must be shown as unavailable; it must not return fabricated success. Future server-wide controls may restrict access during abuse or maintenance in a proportionate way.
9. Cultural and historical review
Culture, interface language and fictional genre are separate settings. A culture is not a personality type. Tools requiring evidence are withheld from publication until sources and usage are reviewed. Even reviewed data can have omissions, contested readings and period-specific limits.
For sensitive or publication-critical cultural and historical work, consult appropriate sources and knowledgeable reviewers. The tool’s technical validation cannot replace that judgment. Report a possible factual error with the page, disputed claim and source so that it can be examined.
10. Third parties, links and future advertising
Links to sources are provided for context. We do not control those sites or guarantee their continued availability or policies. No domain registrar, account provider or trademark search service is connected in this edition.
No advertisement or paid subscription is currently enabled. If advertising is added, it must be clearly distinguishable from generation, copy, save and navigation controls. Users must never be instructed to click ads to support the site, and invalid traffic must not be encouraged. Advertising approval, search rankings, search inclusion and revenue are not guaranteed.
11. Availability and changes
The service may change as tools, evidence and stories are reviewed. The current development scope targets 200 differentiated tools. That target is not a current count of working tools, publication commitment or performance promise. We may combine overlapping candidates instead of creating repetitive pages.
Reasonable efforts should be made to preserve export compatibility when storage formats change, but uninterrupted service and permanent compatibility cannot be promised. Material changes to privacy or user rights require appropriate notice and any consent required by law.
12. Warranties and responsibility
To the extent permitted by applicable law, this development service is provided as available, with the limitations disclosed on each page. It is not professional legal, historical, linguistic, marketing or publishing advice. No statement here excludes a non-excludable statutory warranty or mandatory consumer right.
You decide how to use outputs and should keep backups and perform appropriate clearance and factual checks. Any limitation of liability must be interpreted subject to applicable law; these draft terms do not attempt to exclude liability that cannot lawfully be excluded, including applicable duties concerning fraud or serious misconduct. Final liability wording requires the operator’s jurisdiction and legal review.
13. Ending use and records
You can stop using the tools at any time and clear local data through My library or browser settings. No cancellation or subscription fee exists in this edition. Clearing data does not revoke permissions already granted for ordinary use of exported generated results.
If a future account-based service is introduced, its suspension, closure, data export and deletion process must be published before accounts are accepted. It must not be retroactively assumed from this local-only edition.
14. Questions, disputes and legal notices
Contact the service email listed above with a clear description of the issue, page and relevant facts, omitting private manuscript content unless necessary. Copyright complaints should identify the protected work, disputed location, contact information and the basis of the claim; any jurisdiction-specific formal process remains subject to legal review.
Nothing here requires arbitration, waives class procedures, selects a court or limits mandatory consumer protections. Governing law, legal notices, age rules and dispute steps remain prelaunch review items. If a term is unenforceable, mandatory law governs and the remaining terms should apply only to the extent lawful.
